§1. General Provisions

• These Terms of Service set out the rules for using the aiwake.eu website (hereinafter: "Service").
• The owner of the Service is aiwake.eu, email: contact@aiwake.eu (hereinafter: "Service Provider").
• Using the Service constitutes acceptance of these Terms of Service.

The Service presents the Service Provider's offer, which includes in particular:

• Design and development of websites and web applications.
• Optimization and search engine positioning (SEO).
• Social media account management (Social Media Management).
• Implementation of automation and Artificial Intelligence (AI) solutions.

The content on the Service is for informational purposes only and constitutes an invitation to enter into an agreement. Detailed terms of service, schedules, and remuneration are determined individually in a separate written cooperation agreement.

§3. Limitation of Liability for Results (Key Safeguard)

• Estimative nature: Any data regarding potential profits, increase in the number of customers by a given percentage (e.g. "50% more inquiries") or improvement of statistics presented on the Service is for illustrative purposes only. They reflect results achieved under specific historical conditions and do not constitute a guarantee of identical results for every User.
• SEO and Social Media Services: The Service Provider performs services with due diligence, but due to third-party algorithms (e.g. Google, Meta, TikTok, LinkedIn) that are independent of the Service Provider, it does not guarantee achieving specific positions in search results or specific reach/number of likes on social media.
• AI Tools: The Service Provider is not liable for any errors, inaccuracies or so-called "hallucinations" of AI models used in projects. AI output should always be verified by the User.
• Business Decisions: The Service Provider is not liable for damages resulting from business decisions made by the User based on the content contained in the Service or the results of the delivered tools.

§4. User Rights and Obligations

• The User undertakes to provide true data in contact forms.
• It is prohibited to use the Service to send unlawful content, spam or to take actions that may disrupt the operation of aiwake.eu servers.

§5. Intellectual Property

• All projects, graphics, service descriptions and logos posted on the Service are protected by copyright and are the property of the Service Provider.
• The portfolio works presented are protected by copyright. Copying them for use as one's own projects is strictly prohibited.

§6. Contact Form and Inquiries

• Submitting an inquiry through the form is free of charge and does not oblige you to enter into an agreement.
• The Service Provider undertakes to protect personal data in accordance with applicable regulations (GDPR). Details can be found in the Privacy Policy.

§7. Complaints

• Users may submit complaints regarding the operation of the Service to the email address: contact@aiwake.eu.
• A complaint should include a description of the problem and contact details. The complaint handling period is 14 days.

§8. Final Provisions

• The Service Provider reserves the right to change these Terms of Service. Changes take effect from the date of publication on the Service.
• In matters not regulated herein, the provisions of the Civil Code and the Act on Providing Services by Electronic Means shall apply.
• Disputes will be resolved by the court competent for the seat of the Service Provider.
